Iv just got off the phone to my friend and she is in a right mess. Im so mad iv gotta tell someone. I did my first Airbrush course with Creations and then spent over £500 on all the kit. Got home to have a play and my airbrush wasnt working so the next day went to Capital and showed them. They made a call to Creation, who basic said it was my fault it was broken but they wanted me to send the gun to them so they could sort it out. At this point i was really mad because i would be without my gun for a week so i said no i wanted Capital to replace which they did but Creation were not happy. Well my friend called me last night to say she had finally saved enough money to buy the whole kit and couldnt wait to get started. 3 txt later another phone call asking if the paint was surpose to fly out of the top of the gun
! I said it sounds like a blockage and to put some clean fluid through it and see if that helps. Well this morning i had a crazy woman on the end of the phone saying that Creation have told her to send the gun to them because it sound like she has a part missing and they will try and get it back to her in 2 weeks How do companies get away with this kind of treatment....! Sorry to go on...i'm so cross its just not fair. |

perhaps worth a call to the citizens advice. Surely it's the same as anything you buy from electrical to clothes etc... if it isn't suitable for the purpose of which it was sold for (which is very obviously isn't if it doesn't work!) then legally i think you are entitled to a replacement (not a repair). You aren't asking for your money back here, you want your item replaced. It's not like you've had it for 18 months and it's broken within their 2 year warranty period...
i would make a call to CAB and determine your rights then, if you are in the right, you will confidently be able to insist on a replacement. |

Who did you pay? Capital or Creations - if it was Capital then it is up to them to replace your item and then they sort it out with their supplier - your contract is with whoever you paid your money to - I believe.

Like me she paid her money to Capital...When she rang Capital this morning they informed her to contact Creations.

trade descriptions act 1977 states 'goods must be fit for purpose' Your contract is with person/company you paid the money too who are legally obliged to replace or repair. Go back or telephone calmly and state your facts ie bought faulty goods, can you have a replacement or refund. Don;t loose your rag and listen to what they tell you but stand your ground. Asking them if they have any other problems with this product usually helps too

The rest of the girls are right here. You have a contract with Capital so it is them who you should complain to. You don't have a contract with Creations. Capital has a contract with Creations. Also normally goods will have a guarantee for a period of time after purchase, normally one year for larger items which I would say that this might be. Don't be fobbed off by these people. You should get an immediate replacement for the item and then it is up to Creations to contact Capital and negotiate with them. |
