Does anyone have any experience in this- my friends employee burnt a client t doing IPL- she did not do a consultation form. So does the claimant sue the salon owner or the therapist?
 
If the therapist is an employee then they work under the insurance policy for the salon so it's the salon owner.
 
thank you Trinity- I wonder if her insurance will even pay out as the therapist was booked to do a consultation form but only did a verbal one we think- therefore nothing signed?

If proper procedures weren't followed then the insurance could be void and then the owner could be directly sued as the owner of the business and if not a LTD company, could personally be liable in court.

It means she can't 'personally' be liable so personal assets are safe but it doesn't stop the whole business being gutted if required to settle any court order.
