Help Please-renting a room but the salon owner is not legally allowed to lease it

Good morning fellow geeks

I've got a pretty sticky predicament. I am leasing a beauty room and have just found out the lady I lease it from is doing do illegally. Basically the building owners came in for a premises inspection while I was in and asked how I was enjoying working for this lady so I said fine as I'm still self employed so I have freedom over my work.

It transpired that the lady is NOT allowed to sub lease in any shape or form and that I'm actually paying more rent than she is!!!

So the building owners have said they are going to decide what they want to do and whether they will even keep the salon or just sell the salon off as a business. But they said in all honesty they would probably just sell the business as they don't have any clue about the beauty industry - they deal in property!!

I may lose my business which is pretty stressful and have to start looking for another room. Should I be looking to reclaim any of the monies paid to this lady or even look for compensation? If so how?

Also should she be reported to anyone to stop this happening to any other therapists?

Would be grateful for any help.

If she is renting the building from them the 'business' is hers not theirs. It will depend on the terms of the lease as to how much notice they have to give her if they want to sell the building.

Ideally, you should have a written agreement with her to sub let. If you haven't there isn't much you can do. If you have there will be some claim on her

What ever the freeholders of the building decide to do they will probably enforce the terms of the lease and you will have to go anyway. They may also use the sub-letting situation to cancel her lease as she seems to have broken the agreement!

I think you need to look for another premises and check it can be sub let before you sign anything

I've started looking for other premises already but most of my local ones are not renting rooms so will have to keep looking.

I do have a written and signed lease with the lady which the owners have asked for a copy of. My lease states that the lady is allowed to let the room, which is obviously not the case. Given that the lease I hold is false do I have any grounds on which to ask for monies back from her?

Has anyone else had this problem?

by law you are a squatter and have rights seek legal action. have you got a contract or anything in writing which says/states you are paying rent to HER or Them if so, take it with you you can get FREE legal advise so just try but if you have a key or any belongings within a room it is legally yours. the only way out of it on their part is if they have an item within your personal working space and if you do not have a key. so yes you should be able to claim all that rent back off them if they ask you to leave. Hope this helps x
