I was on maternity leave and my manager gave out my details to some clients without my permission to send cards and presents. I was very ill so I would have prefered her to leave them at the salon however now she is accusing me of stealing numbers from work! Were do i stand does anyone no!?:eek:
 
Why is she accusing you of stealing numbers? Have you been doing the clients at home?
 
ive gone self employed mobile and had an advert out so clients have heard and got in touch with me.. shes saying shes taking action but she is in the wrong for giving out my details surely? she doesnt own the salon shes just the manager I havent done any clients within what my contracts set so I dont understand whats shes going on about!
 
If you havent contacted any clients then its ok. If you are being paid maternity pay still then you are in trouble.

Think you need to get all your evidence together and see a solicitor.

If you are still getting maternity pay then you can only work a MAXIMUM of 10 days and still get your benefit. You also have to let them know the dates you worked.

Once you get to 10 days you either have to call them and get your maternity pay stopped or you can't work again until your maternity pay ends.

ive already spoken to h m revenue and they said as its statutary i can work self employed and dont pay it back!?
 
Mmmmm I would get a second opinion on that just to be on the safe side. I had maternity allowance rather than statutory as im self employed and was only allowed 10 days work.

The following link seems to indicate that if your employed you can't do any work at all unless its for your employer but then again it doesn't mention any additional self employed work.

I really would check what you have been told as lets face it women up and down the country who are on maternity pay would be rushing out to do cash in hand work on top of their benefit if its allowed.

You need to actually speak to the maternity pay department for your area not h+m.
 
I not 100% on this, but I thought SMP is paid through an employer to an employee. I can't see how you can still get SMP if you are no longer an employee?
 
Well, yes you can, but you cannot work AND get SMP. If you are declared as self employed then the salon should stop your SMP.
 
i spoke to acas and to h m revenue who put me through to a department and because your not employed by another company the statutory matrernity pay has to continure until the 39th week. I pay tax on my self employment so its not cash in hand. So ive doublechecked with two places and its correct??
 
I don't think that is correct!! You have to stop working (either employed or self employed) until after the 39th week as otherwise you can have to repay the maternity allowance.

If you are paying tax on your self employed income then when you do your tax return you have to declare your maternity pay and then they will ask for some back of you i think.

You would still be able to work 10 days as 'keep in touch days'. Once you have used up your 10 KIT days and you do any further work, you will lose a week’s SMP for the week in the Maternity Pay Period in which you have done that work.

if you leave the employment they still have to pay up till 39th week including any holiday you have built up.. and you can go self employed as you are not employed by another company

hope this helps if any one else wants to go self employed and are worried
