Hi guys

Ive just opened a shop and spent £28,000 and it looks lovely.
However the idian restaurant upstairs has a number of leaks and in three weeks we have had to pay for two suspended cielings to be redone.

The thing is their water and ours is connected for some reason and and if we switch it off theres goes off.

The leak has begun again and has damaged our beauty room cieling and is now starting in the salon. The restaurant has been in and stated if we dont switch the water on that they will take legal action for loss of business as they say the tennat of the restaurat is away and wont be back till monday.

What can i do, if i switch the water on it may leak again over the weekend (however they said they have stopped the water to that part of the building but not the kitchen area, i dont know how true this is?) also if i leave it off im frightened i may be in for a big bill due to their loss off business.

can someone advice me please I dont know where or who to turn too. The landlord is trying his best to help also but cant get anyone up here (he lives down south) untill tomorrow

What does your lease say? Does it say that the water has to be kept on?? I presume your insurance covers the leaks anyway?? If so i would personally leave it on but go back a few times over the weekend to check on it. If it isn't mentioned in the lease you could leave it was an accident!!
 
I personally would suggest that the person standing in for the restaurant tenant/owner should call a plumber out before the water is turned on or you will present them a bill for your damages and possible loss of business due to damp smells and such off the leaks.

Perhaps ring your insurance company to cover your back hun xx
 
whatever happens, you can't live your life like this, leaving your business and worrying all evening if you are going to come back the next morning to a leak and a mess.

what about YOUR loss of earnings? How can you possibly have a 9am client booked in and not know if the salon is going to be presentable and safe to do the treatment.

You need to talk to your landlord about this but spend the weekend surfing the net to see what your legal rights are for this.

You have spent a considerable amount of money getting this business up and running so its not really feasible that you leave.

i realised i had legal advice with my new insurance company lol. I have telephoned them and they said to leave the water on an send them a letter! saying they are being neglagent because they know about the leaks and have not done anything. give them seven days to get it fixed or then apply to the court for an injunction!! seven days my business could go under by then! what would happen if the water drips on the electric lights and then bang! someone is killed!! its rediculous!
 
Why are you paying for the ceiling to be re-done? Surely you should be sending the bill to the restaurant or to the landlord. Keep a record of your costs and check your lease and your insurance details.

If you have to leave the water on over the weekend make sure you switch off and cover all electric equipment. Put down paper or plastic if you can.

Your landlord should be able to sort this out from a distance - he can send in a plumber or whatever trademan you need. If he can't - tell him you'll find one yourself and send him the bill.

it's hard enough to be in business at the moment and to get customers in through the door - don't let this unfair situation make life even harder for you.
 
Oh my god you poor, poor thing!

I would take photos of everthing damaged your end, and keep a log book of every single detail, dates you have conversations with whoever from upstairs of insurance, and what excatly was said, what you have paid for to replace/fix things dates it was done etc. Even dates & times water was turned on & off!
