Weeks notice pay?

if you pay someone off and they are due a weeks notice pay, are they due it by the last day of the notice period?

i thought that i could pay her at the end of the month when she usually gets paid? x
 
Strictly speaking it should be payday, but you are better off to do it quick, and get rid of this problem sooner.
 
thanks. she just called me saying citizens advice said it should be on or by the last day of the notice period, which was saturday. just riles me that she is gonna use it to buy her homer kit to do all my clients...will phone my accountant tomorrow to sort it.

Has anyone registered badbeautygeeks.com? I see it as no different to Credit Scoring. Doubt it's legal though.
 
mmmmm dont know where you get paid on the last day of the notice period came from, I'm sure its on your usual pay day ....................................
 
On the normal pay day, and at our place you get any holiday pay owing 2 weeks after that, but we work 2 week in hand.
Honestly some people think all they have to do is say it and we will all fall in with it without checking:rolleyes:

In my life before lashes I worked in payroll :zzz:

Worked for a company doing all the government payrolls, paying MP's, doctors etc. And when they leave they get paid on their normal payday. Also worked on the American Express payroll, and once again when they leave they get paid on their normal payday, not on the day they leave.

I can't say 100% if what your ex employee saying is right, but if the big companies 'get away' with doing it every month, then I don't see the problem. But you can always double check with HMRC. Their employer helpline no is 08457 143 143, but your accountant will know.

That aside, if it was me I'd pay her on her normal payday. Why would you want to help someone to get thier equipment so they can poach your clients? Business is busines after all.

Besides, if she wanted to sue you, you would have paid her by then!

Legally you don't have to pay on her last day of work.

You have to pay her on the next schedule pay date.

Should she insist on earlier payment, she should bare the cost for the accountant fee to sort out her pay slip and payment.
 
she should bear the flaming cost of me going to a blooming therapist after this situation. part of me thinks just give the stupid girl the money and get it over and done with, part of me thinks shes screwed me over so much already that i dont wanna pay her evr, so ill leave it to last possible day. she called on thurs to ask when she'd get it, i said i was in talks with my lawyer and didnt know yet but wold let her know, she called again yesterday and said legally she should have got it and i said she'd be hard pushed to cos banks were closed friday saturday sunday and monday so i havent been able to do anything about it since thursday afternoon when she called. she told me citizens advice said it, but i had spoken to my lawyers trainee about it and he said i could leave it til end of month if i wanted to.

are psychiatrists bills tax deductable?? cos i think im seriously gonna need one.

I would say pay quick and get rid but if you can tough it out and make her wait then good on you.
 
i am scared to answer the shop phone as she keeps calling asking about it...so i called accountant and she is processing pay slip now. i feel sick when the phone rings...god knows why cos i know when i pay her it will be good riddance to bad rubbish...will feel better when cheque is in the post tomorrow. thanks everyone x

i very nearly did. i thought about doing it, or not signing it...lol. thought it would just make me look petty. on the upside she might not get it til friday now, by which time she'll get her letter from my lawyer and will be told shes not getting benefits because she was sacked for misconduct. whos the smarty pants now?

Although he he it would have made you feel better in the short term if you had 'forgotten' to sign the cheque . . . I never thought of that one!

the worst thing is, if i got a letter from a solicitor i would be s**tting myslef, she'll not give two hoots.

considering phoning up and reporting her for doing homers too as i know she isnt declaring it, but leaving it a while until i can decide whether im doing it for thr right reasons or not.

Yes, there are laws in place which protect the employee but in the case of a breach you can challenge them (and succeed). This is why, as a business owner, a good lawyer at your disposal is imperative :)

Best to get her out of your hair quick smart.
 
hey, ive got a lawyer, but becasue she has breached her contract i must pay her, then try to claim the money back. if i withheld payment, then i would be in the wrong. when i left my previous job i was due 5 weeks holiday pay, a weeks notice and around £200 in commission. I got £50 commision and another £100 which was a tax rebate. I never fought it but now i wish i did cos it seems im the only mug in the world that didnt. im getting hit left right and centre by this girl who has STOELN from me yet the law is i must give her more!!!!!!! its unbelievable but the law is there to protect the employee not employer.
