Keeping business name

Hi, my business is currently up for sale, can anyone tell me if I sold, could i retain my business name so that the person purchasing couldn't open under my current name?

Only if your name is a registered trademark and it wasn't included as part of the sale.

Or, as part of the sale contract, you included a clause that you retain your name and they have to rebrand.
