over 2 weeks late and still no wages!

Hi all,

I left the salon i had been working in for the last 8 months, about 3 weeks ago (for MANY reasons!) and i was due to be paid my final wages including any accrued holiday pay on the 30th oct. The day i handed my notice in i had also been to the drs and they had signed me off work due to stress (and yes it was work related!) for 2 weeks so i asked her what woould happen about my wages and she said she'd give me a call. So after a few days, she said to come to her house to pick them up- which i did, only to find that they weren't there due to "a problem with payroll" so she told me to come and collect them from the salon the next week, when again i came home empty handed because "they had just been to busy" and "it isn't just an overnight thing there's holiday pay etc to think about" by now i am fuming because they were already a week late and i had been relying on these wages to pay the bills etc! To top this all off, she told me to keep my sick note as i would need it to claim through the job centre! So i tried to make a claim for employment and support allowence but couldn't even do that because she hadn't given my last 2 months wage slips or p45! so basically i have had no guarunteed income whatsoever for the last month, still haven't been paid and am so worried that i wont be able to get my son/ partner any christmas presents- let alone pay the bills for the next few months! (when i will be starting another salon job)
I have been the CAB and they advised i write my boss a letter to say if she hasn't responded by 14 days, i will take legal action. The 14 days ends this tuesday (17th nov 09) so i guess i will have to take legal action!

I am not the first person she has done this to and i am sure i wont be the last! cant believe she's getting away with it!

Has anyone else ever had this problem? if so did it ever get resolved? does anyone have any advice they can give me?

i am so distraught over this :(

Have you actually written her a letter yet? If not then you need to, stating what she owes you and giving her 14 days from the date on the letter to settle in full. She is also obliged to sort out the sick pay is the period you were signed off for, falls within your notice period as you would still be technically working for her.

If she hasn't paid up in full after the 14 days then I would think that the next stage is small claims court - ACAS would probably also be a good place for advice.

Good luck with it - its totally not on and you can get this resolved. She owes you this money and has to pay it. :hug:

Thanks for you reply, yes i wrote and sent the letter on the 3rd nov, so the 14 days runs out this tuesday. I will try ACAS if she hasn't replied by then (which am pretty sure she wont!) do u know what they will do to resolve this? she never answers the phone and i've never seen her open any of her post (just a big pile in a drawer) so i dont know if anyone will ever get through to this woman!
 
Did you send the letter by 'sign for', if you have already had a tracking info stated that she received that letter you sent her. You can use this info approving that she intentionally neglect and now it will be easier for the legal advice who will come to help you.

Try to find any paper evident and collect them together and if it's possible, if you could get the witness as you said you're not the first one whom she did this.

I'm sure that employment law here in is very serious and you should get more compensation including the fare interest rate for all money she own.

Yes i sent the letter by recorderd delivery as advised by the CAB, i haven't had so much as a text or a call of her in over 2 weeks, so i know she is intentionally doing this....i just hope she doesn't get away with it again!
