confused by holiday pay etc. if someone leaves just as they start their holiday week... So technically the holiday week is the notice...paid weekly. Do you pay the week plus another week? As in they would be due holiday pay anyway or just a flat week? Also as they acrue holiday pay for every day they work does that mean the notice week entitles them to more holiday pay?

They get all holiday pay accrued till the day they stopped working, and notice pay if you are putting them on garden leave otherwise they will have to work the notice period.

Depends are you dismissing them? Are they going on garden leave?

Basically despite handing in their notice, they are still officially an employee of the company and therefore entitled to benefits etc. In the same way as the HMRC would expect the company to continue paying NI contributions etc. You therefore give them holiday pay accrued up until their last day especially when some notice periods are 3/6 months long.

No clauses put in contracts can change this, or the act of garden leave as you are still considered employed.
