Has anyone had to deal with this? If so how did you get on? X
 
It depends what the circumstances are surrounding the claim, is this something that you are pursuing or is someone pursuing you? The question doesn't mention the reasons as to what you are trying to do -

In scotland it's small claims up to £3k then summary clause up to £5k

Court fee are free to those on tax credits


In scotland you cannot do it online you have to send it in you then get it sent back and you have to either get a solictor or a sheriff officer to serve it which is £30 recorded delivery and around £100 if you require sheriff officers to serve writs personally.


There is always a risk of being counter sued and their legal expenses.


I find the law very interesting and have just served a summary clause on a business who thought they could intimidate and bully me. It's a gamble and a test case but if there is not people to challenge some people think they are a law on to their self. Courts make them accountable, although there is stress involved but courts are there to be used so you may as well.
