Hi Geeks

I have been lucky enough to be given a list of clients from a nail tech who is moving to another area to have twins. Now I really appreciate the list given to me it has email phone numbers and addresses. Could any of you give me advice as to the best method to contact them and tell them what I can offer. should I mention that I have been given their details ?

Any advice appreciated

I think you ought to look at the legalities of just contacting people.

We're living in on "opt-in" phase at the moment where people have to specifiy thats its ok to be contacted. There's data-protection issues I think.

I know that seems rather heavy-handed as its just a list of names- but all it takes is one picky weirdo to take offense and your friend could get in trouble for handing over peoples private data.

Sorry about giving you the problem and not a solution :o , but its worth thinking about!

Hiya,

Yes you can only, legally, get hold of personal details like this if you buy or take over the business that holds them.

Simply passing around peoples personal details is a big breach of the data protection act

Hi All and thanks for the feedback, I have to be honest and say I was unsure so let me make the situation more clear ( not that im sure this is still right so appreciate any feed back) The salon offered sunbeds spray tanning and nails. The sunbed has been sold along with the outstanding vouchers to the local gym. The nails and spray taninng had not been sold as a business ( the salon now been leased to a florist ) Now I have brought the spray tanning equipment and products and I have been provided information of all exciting spary tanning clients however some cross over to nails as well.

Not sure if that makes thing any clearer or if the information you have provided still stands ??

Thank you

well- we have to be realistic..you're a micro-business, so the chances of you actually getting in data protection trouble is slim.

However, people on here should still provide sound "legal" advice- and even in those circumstances you talked about, you'd be breaking data-protection laws- you bought the products, not the business.

This is just my understanding of the data protection act and I may be wrong but... If somebody gives their personal details to salon 'A' then salon 'A' cannot sell or pass on any of this information on to anybody else, without the consent of that client.

As you are not taking over salon 'A' as a going concern (which would allow you access the data) the correct way to go about things would be for salon 'A' to contact their clients, by letter, explaining the situation and asking if they would be happy for their details to be passed over from salon 'A' to salon 'B' (you ;)). You could then contact the ones who agree.

Hi again,

thank you again for the information. I would not want to do anything that I should not, also would not want to get anyone in trouble. So I suppose my only option is to send these people a copy of my price list just so they know im here, would that be acceptable ?

Well- theres nothing actually stopping you putting flyers through letterboxes is there? Or even an introductory letter.

But be on the safe side and don't mention the other girl, and don't mention she gave you their details.

I think you can't really do that as you have been given there personal information with out there consent, so if you wear to use the info to call, e mail or send them a price list then this would be looked upon as using there information with out there consent,
I think if you had moved into there old salon and taken over then it might have been sold to you as goodwill (a client base would pass along this way )
But if you have only bought there equipment and not there business or name then I should think you would be in breach of data protection ,

I think if you wear to ask the lady to do a letter to them all for you and send them explaining shes having twins moving ect and recommending you and including your info and price list then that should be ok , you could even print them , and pay for the stamps your self but ask her to sign.

Some info about goodwill What is Goodwill?

Thank you again, as you say it's best to make things clear for everyone especially me :D

wow. i can't believe somebody would pass on somebody elses details without even asking them. i would be so peed if somebody had given my personal details to somebody else. it's so unprofessional. like everybody else has said i'd be very careful. you could always get in touch with somebody like citizens advice and ask what the laws are surrounding giving out personal info and take it from there. x

I have been in to see the salon owner on my way to pick up the children. I gave her the list along with loads of my paperwork and asked her if she can just pass my details on. She is feeling very sick at the moment with being pregnant and has been in and out of hospital. She told me she was glad I had gone back in as on reflection she should not have passed information on without client consent and she didnt know how to approach me to address her error.

Im happy with how things have turned out, and thank you all again for advice it can get very complicated, as I said I would not want to do anything that could get people into trouble :o
