advice needed for employment contracts

Hi all

Just a quick bit of advice needed really - I am just about to issue my two beauticians with employment contracts - I am downloading the standard ones on the government website - but I wanted to know if any of you salon owners put a clause in them about not working in another salon in the same area for a certain amount of time if they leave. Any help and advice would be gratefully received.

When I rented space in a beauty salon, there was a clause in my contract saying that after I left I couldn't work within a 3 mile radius of that salon for a period of 6 months.

I suppose that would only work depending upon your location, as for me personally there arent many salons within a 3 mile radius and if I was issued with that clause in a contract I would think twice about signing it. I agree that if you leave before a certain period of time you should pay back for your uniform and any training, but I dont see why you wouldnt want them to work for another salon? Mind you, there would be nothing to stop them from going mobile, unless you put that in the contract too.

I would be less concerned about where they would be working if they left you, and more concerned about making the point in the contract that they cannot use your client or mailing list for their own purposes.
 
I would recommend that you go and see a solicitor, because such a clause is unlikely to be enforceable. The contract of employment is valid until the employment ceases. When that contract ends, you cant enforce terms from within it.

Like Skymark has said, you would be better of focusing on ensuring that the contract states that clients are the property of your salon, as are client records and info, and that the employee may not approach your clients with a view to gaining business from them.
 
yes i have clauses to stop them poaching my clients or working within a certain radius of the salon for a certain amount of time.
I was luckly enough to find a lawyer who wrote a piece in a trade journal he provides all my contracts, salon handbooks etc for £150 - he is also available to answer any questions whenever you need.
he specialises in salons and knows the law inside out.
it is money well spent for the piece of mind

I was reading through the site and i came across your post with regards to a solicitor drawing up contracts. I'm in the process of openining a salon and will be renting space and rooms and don't want to be left in the lurch at anytime by self employed staff. In your post it said to contact you if in need of a good solicitor, so here i am!!!:) any help is appriecated.

So what would happen then if you had two part time jobs in salons about 6 or 7 miles apart do you think that would matter?

I do not think that if you only have a part time job that an employer can stop you from earning a living.

Any thoughts?
 
the contract is th emost important document you have.There are loads of clauses to help you eg a long probationary period,recovery of training costs and of course a restrictive covenant to stop people leaving and opening up in competition close by.You dont want a standard contract you want one specifically for the beauty industry

you need a contract specifically written for the beauty industry.
Along probationary period is very helpful,a facility to recover training costs if staff leave and most importantly a correctly worded restrictive covenant to stop staff leaving and opening nearby in competition
