I work in a specialist salon and I am planing on leaving my boss has put in the contracte that i can't work doing what we do for 12 months there is no restrictions on where I work its just how long I have to wait nothing I do is trademarks so can she do this

For a restrictive covenant to be enforceable, your employer would need to prove that it is:
  • reasonable
  • necessary to protect legitimate business interests; and
  • of a duration no longer than is necessary to protect those interests
However, they cannot be used as a restraint of trade.

It sounds unenforceable to me but you’ve only provided limited information here so I recommend getting the actual contract checked by a solicitor who specialises in employment law.

Thank you for replying it is a hair loss salon I have now spoken to someone and they have told me the same as you that there is not much that can be done to me aslong as I am not going on the door step
