That's funny they state that as I know of 3 cases of people being sued because a skin test was carried out 24 hours before not 48hours.

Depends who they were insured with and their policy states as I assume all companies are different
 
Yes that's what I said if your not babtac you need to check with your insurance company.
 
I think I would now be inclined to test every time as well now. You just never know and it is not worth the risk. I had a regular client who used to have a particular facial treatment. I did patch test her and then did regular treatments. One day she over reacted and although it turned out OK, I realised that testing once is not good enough. She had become more sensitised due to her menstrual cycle and never warned me of it although clients have to fill out a questionnaire. Clients skin can change just like that - the inconvenience of regular testing is far better than the stress of being sued and all it would entail.
 
I haven't noticed the new instructions, thank you. But my insurance states i must , i have just renewed (royal sun alliance), i have been with them for about 7 years. Does anyone elses insurance stipulate this ? I would seriously consider changing companies, it is losing us so much money.

I used to have insurance with a more generic insurance company (as oppose to one specialising in beauty) and found the small print shocking. I wasn't insured to carry out any massage treatments on a pregnant client. I didn't know this - I assumed that common sense would prevail. It was only while looking through to see if I was insured to massage pregnant clients that I saw this. I rang the company and explained my training and qualifications, but they told me I would not be covered.

I rang BABTAC, discussed my qualifications and training and they would insure me.

This all turned out fine for me, but I vowed then that I would only ever now be insured with a company who specialised in beauty insurance!

We thought we'd pop on and add to this thread :biggrin: You will always need to check with your individual insurer as to their own policy, however we wanted to confirm that our policy is for you to follow the manufacturers' instructions when it comes to patch testing.

For your info, the reason that we ask you to follow manufacturers' guidelines is that under UK and EU laws, manufacturers' are required to carry out extensive testing prior to bringing a product to market, to ensure it is safe and fit for purpose; during that testing, they will form guidelines for each specific product, based on a number of things including reactions and potential reactions from the test group. Individual products and formulas will contain chemicals which have the potential to cause reaction and the manufacturer themselves is best placed to assess the likelihood of this occurring. We do not carry out the same tests on products as it would be too expensive for any insurance company to do, therefore we believe that the manufacturer is best placed to advise on the application of a product. If they are advising to patch test 48 hours prior to the treatment, then this is the advice you need to follow as the instruction will be included to reduce risk.

We appreciate this will have cost and time implications and may result in lost business, however consumer safety is key and a patch test is a good way to reduce risk for them and you.

As an aside, when it comes to insurance claims involving patch testing, many will use training as a defence advising 'my trainer told me I needed to patch test once' or similar. In these cases, commonly accepted industry practices will be expected regardless of the quality of training, as will an assurance that you follow manufacturers' / product guidelines. This is to prevent poor quality training becoming a defence for poor practice and isn't just a beauty industry measure, but a standard insurance practice.

I wish and i think its about time manufacturers could supply some kind of sealed fool proof testing kit you could supply to clients, I know the responsibility should be with us but it would be a lot easier.
