Help with lease!!

hi everyone been looking at this site for sooo long now and love it, cut a long story short i used to be in beauty ie nails and waxing years ago but left and have now come back for more, getting on a bit now so decided its now or never to start up on my own:irked:. anyway if anyone can help my question is...after 4 long months of negotiating a lease on the most perfect shop EVER, the lovely landlord has decided to change everything we verbally agreed on!!! we agreed on a bond and 1 month up front which was roughly 2,500, now he says he wants qaurterley payments(1 up front) with bond, which is a lot more, hes also being so awkward about having a 2 year break in the 5 yr lease. now n process of backing out but scared i wont find another shop like it, im all ready to go with so much stuf in my house that needs a home? im so disheartened feel like just giving up. xx
 
Oh dear.... you sound like you are stressed and in a mess....He may have had other interest in the salon?.. Also he may just be looking after his investment..
My questions may sounh harsh, they are not ment to... just getting an idea so us geeks can help you.

1- How long since you did any training in Nails/waxing...possibly do a refresher course..
2- Do you have the funding to go for it?
3- Are you willing to work your arse off for this business... Do you have the time it needs/support etc.
4- Are you passionate about it?.,
5- wHAT ARE YOU WAITING FOR?

I would post it for you but I still not sure how to do this as yet....blonde!

Lost of business have to sign 5 or 10 year leases... you just need to have a little faith in your self..

hi thanks for your reply, yes for the past 6 mths have been doing refresher courses in nails/ waxing and have also done spraytanning, body wraps, man/ped & facials. been a busy girl cos i so want this! have my business loan in place and am ready to slave my guts out!lol my youngest child is now 11 and off to comp so im finally ready to fly the nest.ps have heard that this landlord has a rep for being paranoid and not easy to deal with but his shops been emty for nearly a yr, had a bit of interest a while ago but they pulled out, wonder why???! x
 
Well you have him by the short and curly's.. so to speak... well done for getting the training and the funding...
Offer him a 2year lease with an outlook to extend to 5years at the end of the 2yr term providing all is well ( i am sure it will be). If he has no one intestesed then surely he would take that over having it sit there empty... some people!
How much work would it need?....I say be firm with him and say it is this or nothing.... give him 48hrs to get a contract together.. show him you mean business...
in the mean time look for something else.... sometimes these things happen to make you look outside the square... there might be the perfect little spot for you...you just haven't found it as yet due to the fact you thought you had this one sorted....
In australia we just walk into the real estate and tell them what you want... they do all the looking and you just go look at them and decide which one you like,,, no cost to you at all... jsut sign the lease and you are done...

I had a very similar experience to you! We verbally agreed on everything and when i went to the solicitor he told me to walk away as my landlord would not budge an inch. I managed to have a 5 year lease with a 2 year get out clause, however he wanted a full repairing lease. My solicitor said that I could therefore have a shop for 2 years and the day before I leave be tucked with a huge maintenance bill, for a new roof for example. He said this was only normal practice for leases of 10 years and over but landlords try it on these days.

If this man is being unreasnable now then he could be a total PITA once you have signed the dotted line. Do what I did and get a solicitor to mull it over. Cost me £150, but he sure saved me from a potential nightmare. I wish I had seen him at the beginning of it all and not just as we were ready to sign.

I am also just agreeing my lease, it is taking a bit longer than i thought, the landlords solicitor is taking ages to get back to me on things which is a pain because i have everything in place, joiner, equipment etc...

I have found a great shop and in the perfect location and its over a 8 year lease period, did try and get a breakout clause put in but landlord didn't want that. I also have to pay three quarterly payments in advance i guess its a bit of security for the landlord but doesn't help us much! If you think its a great opportunity stick with it don't back out. I didn't want to loose out on the opportunity so just agreed to it. Just need to keep my fingers crossed and hope everything goes well. Hope to be in next week!
