Can I ask you out of curiousity what is your personal motivation for wanting to whiten teeth? Money? You like teeth?
Also it does seem a bit mad that a dental nurse cannot and a beauty therapist can then doesn't it?

Why did you train in semi perm makeup? You like eyebrows? The money?! In all honesty I wanted to train in beauty procedures to start earning straight away ( I'm currently training in brows, lashes, laser lipo and waxing too ) as I'm a single mum and don't qualify for funding to do a three year NVQ so need to learn treatments which i can earn money from after being qualified. Any money I earn from teeth whitening goes towards training in other courses to provide for my children so yes, in essence, of course it's for the money. But then why does anyone work?! Not everyone's a villain...

Firstly it's not semi permanent make up. Permanent make up is a small part of what I do.

I paid out thousands over the years to get good at my profession and it isn't illegal, I also have relevant qualifications.

I don't just do eyebrows, I treat scars post surgical and trauma, tattoo areola for cancer sufferers and disguise hair loss amongst other cosmetic tattoo treatments.

I first decided to train because I suffer from alopecia. That was my personal motivation for learning.

We all have to earn a living, but it's best if it's done legally and you needing to see a quick return is no excuse for offering a treatment that you are not legally qualified to do. Teeth whitening is not a beauty treatment but is classed as dentistry.
If you want to offer beauty treatments then go and qualify as a beauty therapist, you mention also laser lipo which is an advanced aesthetic treatment, I cannot begin to say how scared that makes me feel.

..., with therapists being prosecuted for administering dental work (ie anything that enters the mouth when your not a registered dentist or dental hygienist even you passing it to them to put in their mouth)
Do you not feel scared that you may end up in debt or in fear of bring prosecuted ? ... No offence just a question I wanted to ask ???
I know someone who although she said was going to stop,, but has continued with this treatment... !!!
Mmmmmm .... I don't see any grey area with what iv read ...
Dental work = dentist ... !!!

The Cosmetics Product safety Regulation 2008: Regulation 3 stipulates.
“Cosmetic Product” means Any substance or preparation intended to be placed in contact with the various external parts of the human body (epidermis, hair system nails, lips and external genital organs) or with the teeth and mucous membranes of the oral cavity with a view to exclusively or mainly to cleaning them, changing their appearance, correcting body odours, protecting them, or keeping them in good condition except where such cleaning, perfuming, protecting, changing, keeping or correcting is wholly for the purpose of treating or preventing disease”.

Megawhite and other legitimate Companies use products that are not wholly used for the purpose of treating or preventing disease, they are designed to "change appearance" and can therefore be properly deemed a cosmetic product.

Furthermore:
The GDC “considers” tooth whitening to be the practice of dentistry under section 37 of the Dentists Act 1984 The Act defines the practice of dentistry as “the giving of any such treatment or attendance as is usually performed or given by dentists:”
There is no reference within this act in respect of teeth whitening,
Furthermore I do not believe that tooth whitening is a subject covered in the curriculum of dental students and I do not believe the GDC offer a specialised course in this at all.
Therefor Teeth Whitening cannot be classed as “the giving of any such treatment or attendance as is usually performed or given by dentists:”

.... Sorry but, I wonder what the Therapists who have been prosecuted say now ...
I think it's a money making mc that these teeth whitening companies are 'fooling' therapists to part with their money and then hanging them out to dry when prosecuted ...
The literature I read was that these companies train ppl in teeth whitening but it's up to the person taking the training to be a registered dentist / dental hygienist to perform this treatment ... !!!

I believe it is already illegal unless you are a dentist.Have a search online I think someone was recently taken to court.

The GDC have a campaign to deter the beauty Industry from becoming involved in the Teeth Whitening Industry. If you read any of the advice in respect of this subject. Please note that they NEVER say it is illegal.

here are some quotes

"we would urge you to cease doing so. Faliure to do so may result in an investigation
by the GDC into your conduct with a view to bringing a criminal prosecution. under section 38 of the Act

They make these vague statements because they are aware that there are some companies including beauticians, dentists, therapists, hygienists and so forth that are breaking the regulations, however they are also aware that there is a growing amount of teeth whitening companies that operate within the confines of the Cosmetics Product Safety Regulations with self administered products.

Megawhite for example should not be confused with a dental treatment. The product has been tested here in the UK and meets the said requirements. The packages are vacuum packed, with instruction for use clearly printed for self administration. No dental advice is given.

Not so every day I do the same job that anyone who purchases from me would do. I have been doing so for 10 years now and receive the same threatening mail from the GDC on a regular basis. If they believed the rubbish they circulate why am I still trading?

Please look closer at these prosecutions, some have been using illegal products, some have been advertising that they are dentally qualified, None have been prosecuted for using a Megawhte product, despite our 10 year trading history.

What I don't understand is, if these are for self administration why is it being offered by many as a 'service'?

Selling a teeth whitening kit for home use, no grey area you can put what ever you like in to your own mouth at home.
You just have to go on ebay & see the vast amounts of products available.

What is the expensive training for? At home kits come with instructions for the client to use themselves at home.

I see you've mentioned your company a few times, and brought up an old thread ;)

I've just joined, there is a lot on here and I believe I have a right of reply. Is that not the idea so that members can make informed decisions

Absolutely - but you should also make it clear that you are representing a company and are promoting that company.

I have said it before, I don't remotely care what the legalities are of teeth whitening. I will never offer it in my salon as the grey area is just too grey!

I don't understand your question in relation to training. this is not something we offer, Instructions for use are clearly printed on the packaging, Its a cosmetic product. there is no training required. You would't expect training courses e.g. in the application of toothpaste, lipstick or any other cosmetic product.

What I am getting at is companies charging £2,000 for teeth whitening courses.

I was thinking of getting someone in once a month to do teeth whitening in the salon as I get asked about it but this isn't something I want to do

Someone has told me though on the news they are going to make it illegal that just anyone can do it & it has to be done by a dentist?? There is a hefty fine come with it as well

Has anyone else heard this?

This is the original question to this thread.

From what I gather Liz you are providing kits for home use? Not promoting 'someone' to do the teeth whitening & paying them to do so?

Is this why wires are getting crossed?

Ive already said anyone can use anything at home, to do what ever they wish to themselves. I do not know anything about teeth & gums. So therefore would not apply chemicals to someone elses. Or advise them how to do so.

You have stated your product is for self application, so there is no need to pay a therapist to apply said product. They would make their cut on the retail.

Or am I missing something?

I see, I also agree that is a lot of money to pay

I don't wish to use this site to directly promote our product, my aim is to provide members with information on the subject as I see a lot of questions being asked and generally with negative responses. I will be happy to answer any questions specific to our products is you care to pm me.

I could PM you my last post, but I am
just trying to see if we had crossed wires about the point in question.

Im not actually interested in selling any kits so I wont waste your time.

Teeth whitening is a cosmetic treatment not a dentistry treatment and that's why it's so confusing.

Therapists that do teeth whitening are NOT aloud to give dental advise or enter inside the mouth.
No one is now aloud to use peroxide anymore since last year.

If trained, you can do teeth whitening "beaming white" they have EU/UK compliant kits available for people who are trained.

You just have to be careful who you go to. And some will always perfer the dentist as it's the mouth. But others don't mind.
Hi my dear,
for your knowledge teeth whitening IS a dental procedure because you're treating/working on teeth, no matter which gel or % you use. If you are not GDC registered you are not allowed to do this treatment. You can get fined up to £5000 if GDC sues you.

I have read the dentists Act of 1984 10 years ago, I could see no mention of teeth whitening contained in it. The GDC do not pass Acts of Parliament, they give their opinions on how the Act should be interpreted. Your opinion and my opinion are every bit as valid as the GDC's we therefor have a difference of opinion.
Teeth Whitening is not illegal. The practice of Dentistry is. I do not provide dental advice, I do not touch my clients, mouths, lips, teeth or gums in fact I do not even touch the product and I do not pretend to be dentally qualified. This I have explained directly to the GDC on many occasions over the years. Why do you suppose I am still trading?

Still not sure what the point of your question is. are you looking for something you can offer from your business?
If so would it be for use in the cosmetics industry or a dental practice?
