Slipped Up Big Time!....

Well yesterday started off so good,,,,,,,,,,,,,then after going in the pool at a brand spanking new leisure club, I was walking back through the changing rooms when my feet literally went from under me and down I went! :o The staff were brilliant though, and as I had banged my head they rang for an ambulance.
To cut a long story short, and after spending 6 hours in A&E having x-rays and a scan, they let me come home. I have hurt the bottom of my spine, my left shoulder and elbow, and have whiplash from hitting my head on the floor as well. I was lucky not to break anything....particularly my elbow which took quite a bang as I landed.

Anyway today I received a HUGE bouquet from the Club staff, wishing me well.

The thing is, the flooring is NOT the right kind for a wet environment. It should be non-slip. There were no signs around to say that the flooring was slippery. I have been advised that I have a good case for a claim, but I don't know which company to approach on a "no win, no fee" basis. Can anybody suggest one?

May i give you a word of advise ?

A shop roof fell in while my other half was inside,he made a claim on a no win no fee basis,they charge that much more than a normal soilcitor he won his case but ended up with not a penny ! Just something to think about if you do intend to claim.

I'd Suggest Going To Citizens Advice,
They Are Free To Start With
And
They Will Put You On To A Reptuable Solicitor, That, If You Do Win You Get 100% Of The Money
And If You Dont, You Dont Have To Foot The Bill..................

Mu Husband Had A Good Case, No Win No Fee .
He Fell Off A Ladder At Work 7 Years Ago When He Was Paye, And We Used A No Win No Fee Thingy..........

OH DEAR - I hope your feeling a bit less brusied soon im always falling over and doing silly things!! lol

Not sure if this will help but on the adverts for injury lawyers 4u they say that they claim all there expenses from the person at fault so you keep 100% of your claim - dont know how true it is though as you never know what all the small print says but worth giveing them a call maybe?

What a nightmare for you im glad nothing serious was wrong and the flowers were a nice touch, they could probably feel the pinch of aclaim already lol. As for a solcitor either the citizens advice bureau or check your house insurance for legal fees etcc.

hiya i was involed in a car accident..it took me nearly 2 years to get any money!!!! its a long process most of the companys are the same....i would just ring round a few a see which one you feel more comfatble with...
 
Oh Martine you must be in agony, I fell straight down on my bum once and I still get twinges now from it. I was advised to see a chiropractor by my doctor. I hope they get non slip mats down asap or ther could be others who are less lucky than you, if you can call your injuries lucky!

If you use ''Injury Lawyers for you'' who advertise on the TV they do NOT charge you anything to claim as they charge their fee from the people you are claiming off. A normal Solicitor will charge you a fee.
Did they x-ray the base of your spine (coccx) as I and rjryan both broke ours falling like you ....Dont want to panic you but its worth thinking about. Mine is ok but a bit like sitting on a golf ball when I am in the bath as it is now like a right angle instead of curved and rjryan (Rachel) has had to have surgery on hers quite a while after the injury happened, as hers broke off altogether.

I will try to find out the company name and pm you Martine,as this company said they did the above.

The small print however stated that yes they do claim it back from the company you have a law suit against,but their fee is taken from the total amount awarded,wich basically means you get what's left.

I am not saying all no win no fee comapnies are the same,i am just saying how this one was and to make you aware to read the smaall print first hth x

How about approach the leisure club for a nice membership, instead of suing them? Might work out better in the long run and you can use their facilities to recuperate - how would you feel if someone slipped in your salon and sued you? For a small business it could be lethal...

... I don't believe in putting in claims in .. I was brought up this way - we were always taught to work for our money :lol:

Hope you're feeling better soon, which is the main thing I think - if you had broken your spine or something and couldn't work and earn a living ever again.. then I would think about putting in a claim if they were liable... but in your position, with some rest and TLC it looks like you'll be fine :hug:
 
If there is any chance that this fall could come back to haunt her :eek: then I think she needs to decide soon if she wants to claim or not as there is a 6 months time limit and after that you cant do anything about it. Rachel has really suffered since her fall and if she could have claimed and was awarded anything then I think she would have deserved every penny she got, as she has had a lot of surgery and distress trying to get hers sorted out.:cry: I too do not as a rule advise people to claim, as some people do this for really silly and trivial things BUT if there is any chance that this fall could have long term implications then I think that is a differnt matter.

I am surprised this happend, as I would have thought that they would have had to have the H&S people round to do a check before they opened, so as to avoid things like this.

You could earn a second income from joining a company who specialises in 'no win no fee' - you know alot about it!

Well thanks for your replies........there seems to be a difference of opinion regarding claiming injury. I have a longstanding back problem, which in the past has necessitated surgery, and in 1993 I was told that I would be in a wheelchair in 5 years time...........BUT I am not!! I intend to be mobile for the rest of my life........but it's things like a bad fall that can cause further complications in the long term.

As I said, I was ADVISED that I had a good case for claiming against the company.....it's NOT a definite move, but obviously I have to not only take into account my own injuries, which yes I am grateful are not anything more serious, but the long term outlook BECAUSE of my existing back condition, and also if I can help prevent anything more serious happening to anybody else then that has to be a good thing I would have thought. :confused:

The option of membership sounds like a good idea, and I will certainly look into it. Just one thing...................the comment "I don't believe in putting in claims in .. I was brought up this way - we were always taught to work for our money"..........Well so was I! I have worked since the age of 16, now aged 51, with only two short breaks for having my kids......... so no guilty feelings here!

Hi Martine,

Just my opinion, but if you do decide to sue them, I would go and take pictures of where you fell to prove that there are no signs and that the floor is slippery (i.e. no non-slip mats etc).

The only reason I'm saying this is, that if the company decides to "fix" things quickly i.e. put mats down and signs up, you won't have any proof that it wasn't your fault and that the necessary precautions weren't taken by the company.

They did complete an accident report, and my daughter signed it as I am left handed and it was my left arm that, at that time, was numb with pins and needles so I couldn't sign it.
