Hi guys
sorry if this has been done before but i cant find the answer i am looking for in the search.
Myself and my partner in crime have just finished prepping our new business :) We are a company specialising in Pamper Parties. I just "published" our website online and in my excitement googled myself (loser!! :)
To my horror another company in Manchester not only have the same business name as us but also specialise in Pamper parties.
I have looked through there site and they have a "copyright" sign on there front page. This is probably something we should have done as soon as we thought of a name! I wondered if anyone had any insight into this ? We have had flyers, logos, cards made up and would be gutted if we had to re do everything for the sake of a name.

Any advice ?

sorry not sure if i made myself clear, we are based in hertfordshire and they are based in manchester x
 
what is the business name? i don't really know what the legalities are sorry
 
its perfectly pampered. which i am sure there are loads of around the world! I am just wondering if because both companies are specialising in the same thing if there might be a problem? Or can anyone put a copyright symbol up?
 
As far as I'm aware there is no problem with you both having the same name, indeed there is another salon within 30min drive of me with the same name as mine and it causes no problems. The copyright on their site probably refers to the web site, not the name.
Of course if anyone else knows different......................

Thats what i thought, its probably to stop people from copying and pasting their whole website, pictures, wording etc.

Yes i think thats probably more logical. As i just done a search for pamper party companies and there are two called "my pamper party" with a copyright sign on both websites.
Scared myself for a minute!
 
If 'Perfectly Pampered' in Manchester is registered with Companies House, then you can not use the same name if you want to register your business as a company.

As a small business operating miles away from Manchester it might not be a problem unless they find out about you choose to contest it.

What you can do, is go onto the Companies House website and do a search to see if the name is officially taken or not.

Sorry, I don't know what it costs just to secure the name. I think it is less than a £100 though.

I have just spoken to someone from Companies house and she said that while neither company are registered it makes no difference , however if they decided to register and then make a fuss about me having the same name they would have rights over the name and vice versa.

it costs £20 to register your business and you need 4 forms to do it.

thanks for that. I did go into companies house and found it so totally confusing, I couldn't make head nor tail of it.

the good thing is guru holistics is not registered and I am totally happy to pay £20 per year to keep it registered.

think I will ring companies house after Easter and talk to them as their website for newbies is totally pants!
 
Almost anyone can use a copyright logo. but u actually have to pay to get ur thing's legally copyrighted etc.
its easy u just get a copyright logo and copy and paste it.
I don't know about cos you've both got same name but i'm guessing. . .it's not a problem because!!...
a lot of hair and beauty salons have similar if not exactly the same name's and offering the same thing's so i personally wouldn't see it as a problem.

Ring up your local citizens advice centre they should be able to tell you!
 
also if your a sole trader then there is not point in registaring your name because you are, for example, sue smith trading as beautybox not just beauty box. Therefore if a company name has been registared you can use it if your a sole trader because your business name is sue smith trading as beauty box.

I am sure this is right, please correct me if im wrong.

If either are limited companies then yes you will have to change. If not, no.:hug:
