Interesting thread! I mostly work in the media and it's a minefield!!!
I agree with those that are, in some way, defending Getty Images. It's their business! They don't have time to research every breach to see if it's a multinational that has funds to pay up or a little mobile nail technician just starting out. They just send out a standard letter to all.
Pictures are safer if you've taken them yourself but there are even problems with that, especially if there is someones face in it or other identifying mark. Their permission should be sought.
As a very general rule, using pictures that are just examples of your work (e.g. my agent has an online portfolio of my work that isn't used for promotion) may be OK. But if the images are connected with sales or commercial promotion, like salon or mobile websites, then it is viewed differently.
